D.C. Appeals Court Casts Doubt Over FDA’s “Premium Cigar” Appeal

On Friday, the lawsuit between the premium cigar industry’s trade groups and the U.S. Food and Drug Administration went before a three-judge panel of the U.S. Court of Appeals for the District of Columbia, with government lawyers arguing that Judge Amit P. Mehta’s decision to vacate FDA’s deeming regulations was incorrect. While the panel’s decision has yet to be announced, a reading of the room indicated they were skeptical of the FDA’s case that they followed the rulemaking process correctly. While this seems like it could be a victory, it doesn’t mean that the FDA couldn’t restart the regulation process all over again.

New Jersey’s Casino Smoking Ban Exemption Comes Back into the Headlines

More on this via the links below, but a proposal to remove the smoking ban exemption that allows casino patrons to light up came back into the headlines this week. After a court ruled that the exemption doesn’t violate workers’ protections, the union representing casino workers appealed to the state’s Supreme Court, only to be denied an emergency injunction, seemingly sending the matter back to the legislature. GOP leaders came out saying that they would get the bill removing the exemption over the finish line this session.

Several Companies Announce New Products for InterTabac 2024

The InterTabac 2024 trade fair is coming up this week in Dortmund, Germany, and several companies, including Casdagli, Dunbarton Tobacco & Trust, and Oscar Valladares Tobacco & Co., announced new products they will show off at the event, which continues to show the growing importance of the European market. Also this week, Joya de Nicaragua announced a new cigar for Spain, while Patina announced a distribution agreement for the Netherlands, making it a pretty eventful week for non-Cuban cigar companies and the European market. Charlie Minato will be in Dortmund for InterTabac this week, providing regular updates from the trade fair floor.
