The Columbus city attorney is arguing that one smoke shop has violated tobacco laws so many times, it should be shut down. While many states have this option, it’s rare to see enough repeated violations that this punishment becomes a possibility.

The judge ruled that Ohio’s recently-passed ban on city’s banning flavored tobacco products is unconstitutional. The state is expected to appeal.

Ohio’s new state law prevents cities and counties from enacting tobacco laws of their own, like banning the sales of flavored tobacco products. The plaintiffs claim the ban violates the state’s constitution and would harm public health.

While Columbus’ existing flavored tobacco ban will no longer be enforceable as of April 24, the fight over the law may not be done.

Gov. Mike DeWine, a Republican, once again called for a statewide ban on the sale of flavored vaping products.

On Monday, the Columbus City Council voted to make the sale of flavored tobacco and vaping products illegal. On Wednesday, the Ohio Senate voted to make the Columbus law illegal.

Leaders in Ohio’s largest city have unanimously approved a ban on the sale of flavored tobacco products.
