Contacting the FDA
healthy premium cigar industry will rely on being exempt from FDA regulations. An effective exemption will not only ensure the interest of premium cigars, but also allow the FDA to regulate other products.
It's important to remember that the FDA has the authority to regulate all tobacco-derived products and has made it clear that products like e-cigarettes and little cigars are firmly on its radar.
We believe the exemption as currently- worded is overreaching and does not accurately address the realities of the premium cigar market. As such, we are requesting the FDA make modifications to its definition of "premium cigar."
We invite you to make this request as well, before you do. Please remember these important points.
This is not the personal freedoms debate.
Premium cigars are different.
More time, more clarifications will not hurt.
If you have data, provide it.
A pricing standard might be needed.
Premium flavored cigars are not the same as non-premium ones.
Spread the word.
There is a real risk that the FDA might see conflicting messages from the premium cigar industry. We believe that our requests are in line with the realities of today's market and the FDA's aims. We believe that the changes we request strike a balance between maximizing the longevity of the exemption, while minimizing the products affected by any changes.
