FDA is once again getting sued for not banning tobacco products quickly enough. Of note, technically, this lawsuit only applies to the menthol cigarette ban and not the flavored cigar ban.

Attorneys general from 18 states, two U.S. territories and the District of Columbia have sent the Biden administration a letter urging the White House to quickly act on banning the sales of menthol cigarettes and flavored cigars.

The new timeline suggest the final rules could be announced in March 2024, but it’s unclear whether that will happen.

This is one of the final steps before the bans can go into effect.

While there are no major policy changes, these announcement serve as a reminder that the Biden White House supports FDA’s plans to ban the sales of flavored cigars and menthol cigarettes.
