Stinky Cigar, the company behind Stinky ashtrays, has sued one of its former customers over trademark infringement.

In a lawsuit filed earlier this week in the U.S. District Court for the District of Nevada, Stinky alleges that Prestige Import Group—through its retail operation, 1st Class Humidors, and other third-party platforms like Amazon—knowingly sold products that infringe upon Stinky’s marks.

Stinky claims that Prestige Import Groups was a customer from 2005-2020, but after its most recent shipment—June 2020—began selling ashtrays that it alleges are knock-offs of Stinky’s designs. According to the lawsuit, this includes selling through 1stclasshumidors.com and other retailers like Amazon and eBay. A recent search of 1stclasshumidors.com and Prestige Import Group’s Amazon’s storefront did not show any ashtrays listed for sale with stirrups.

In January 2021, Stinky Cigar filed for two design trademarks that show two of its ashtrays.
