Cities and counties in Michigan will still not be able to increase the minimum age to purchase tobacco from 18 to 21.

A Michigan Appeals Court upheld a 2017 decision that invalidated a Genesee County law that would increase the minimum age to purchase tobacco from 18 to 21. RPF Oil, a Michigan-based gas distributor that owns four retail gas stations, filed and won a lawsuit against the county in 2017.

In the original decision, Judge Judith Fullerton ruled that the Age of Majority Act states that anyone age 18 and older is considered an adult of legal age “for all purposes whatsoever.”
