Florida Beach Smoking Ban Bill Dies in Senate
A bill seeking to ban smoking on Florida’s beaches has died.
The bill, S.B. 218, was introduced by Sen. Joe Gruters, R-Saratota and proposed to fine violators with either a $25 monetary fine or by requiring 10 hours of community service. Enforcement of the ban would be tasked to police officers.
The proposal drew interest as per Florida state law, only the state can ban smoking at beaches. In 2017, a Sarasota County smoking ban for beaches was deemed to be unconstitutional due to the 2003 state laws regarding smoking in restaurants, workplaces and other indoor areas. In that law, it was written that only the state can make laws regarding smoking.
It had been sent to the Senate Environment and Natural Resources Committee, though it never received a vote and was indefinitely postponed and withdrawn from consideration.
