A nonsmoking state representative in Michigan is proposing a bill to that would roll back legislation passed in 2009 that prevents restaurants from allowing smoking at outdoor patios. Rep. Tom McMillin, R-Rochester Hills, has proposed HB 5159, which would allow owners of spaces that “are less than 50 percent enclosed” to determine if they want to allow smoking.

The bill now has bipartisan supporters and is moving forward in the current Michigan legislature.

In August, smokers received a small reprieve when it was determined the outdoor law would not apply to outdoor areas of restaurants where food and beverages were not served.
