A proposal to ban smoking in New Carlisle, Ohio parks was rejected by the city council this week in a 4-3 vote.

There was concern among council members about the legality of such a ban as well as an infringement on civil liberties, according to a report from New Carlisle NewsMembers of the city council acknowledged that smokers have the right to use the parks as well, particularly since their taxes help fund the building and upkeep of the spaces.

Council member Rick Lowrey went so far to say that if someone was smoking near him in a park, it is his obligation to move, not the smoker’s.

New Carlisle is home to approximately 5,800 residents and is located 60 miles west of Columbus.
