Lavallette, N.J. has is one step away from banning smoking on beaches.

The Ocean County town held the first reading and vote on Monday and second vote, which would make the new rule a law, is scheduled for Oct. 16.

It was one of two practcies the town plans to ban on beaches, the other being the use of tents and cabanas on the beach.

Lavallette is located on the Barnegat Peninsula and has a population under 2,000.
